Our firm secured more than $87,000 in workers’ compensation benefits for a Nevada employee who was injured in a motor vehicle accident while driving as part of his job duties. This case demonstrates how insurance delays can unfairly deprive injured workers of benefits—and how experienced legal advocacy can force compliance with Nevada law.
The incident occurred while our client was driving for his employer on the highway. Another vehicle unexpectedly merged into his lane, striking the driver’s side of his vehicle. As a result of the collision, our client suffered multiple injuries, including damage to his left knee, left hand, ankle, and both his upper and lower back. The claim was promptly reported, and medical treatment began.
Although the insurance carrier initially accepted the workers’ compensation claim, disputes arose once our client reached the end of active medical treatment. His treating physician determined that his condition was permanent, stable, and ratable, meaning he was legally entitled to a Permanent Partial Disability (PPD) evaluation under Nevada workers’ compensation law. Despite a formal request for a timely PPD rating, the insurer failed to move the process forward, delaying benefits our client was owed.
Our legal team intervened to protect the client’s rights. We formally demanded that the insurer proceed with the PPD evaluation, proposed qualified rating physicians, and filed a request for hearing when the delay continued. This pressure compelled the insurer to schedule the required PPD exam and properly close the claim instead of allowing it to remain unresolved.
As a direct result of our advocacy, the client received a vocational rehabilitation lump-sum buyout of $26,141.67, followed by an additional Permanent Partial Disability award of $61,722.65, for total compensation exceeding $87,000. These benefits provided critical financial stability and acknowledged the lasting impact of his work-related injuries.
This case highlights the importance of experienced Nevada workers’ compensation attorneys who know when to escalate disputes and how to enforce the law. When insurers delay or deny benefits, we step in to ensure injured workers receive everything they are entitled to under Nevada law.
